BOOKING TERMS & CONDITIONS
Please read these Terms and Conditions. By using our MAISON50 online booking service or booking by email or booking by telephone you are agreeing to be bound by these Terms and Conditions.
1. Definitions
In these Terms and Conditions:
“you” or “your” means the person named in the booking confirmation;
“MAISON50 Policy” means the relevant policy and rules in force at MAISON50 (as updated from time to time);
“MAISON50” means MAISON50, 50 High Street, Crickhowell NP8 1BH; and
“we”, “us” or “our” means MAISON50, 50 High Street, Crickhowell NP8 1BH
2. Making a booking
By making a booking you are confirming that you are authorised to do so on behalf of all persons named in the booking, that all members of your party agree to be bound by these Terms and Conditions and that you will procure that all members of your party will comply with these Terms and Conditions.
We reserve the right to accept or decline bookings entirely at our discretion. You cannot make a booking if you are under 18 years old and any such bookings will be declined.
A booking is confirmed once we have received payment from you. If you wish to cancel your booking it will be subject to our cancellation terms set out at paragraph 3 below.
When your booking has been made a confirmation will be sent to you by email using the email address that you have supplied. You should retain a copy of this confirmation for your reference. If you do not provide us with an email address, we will not be able to confirm your booking or provide you with details about your booking via email. You can also book via email at [email protected] if you are unable to book online. Booking confirmations are subject to the availability of accommodation at MAISON50.
You should carefully check the details of your booking confirmation as soon as you receive it.
You must contact us immediately if you believe any of the details in your booking confirmation are incorrect or incomplete. We will, where reasonably possible, rectify any inaccuracies or accommodate any alterations you wish to make to your booking at MAISON50. If you notice a mistake or inaccuracy in your booking confirmation, you must notify us as soon as possible and we will, where reasonably possible, amend your booking for you. If you fail to notify us of any inaccuracies or mistakes before the date of your stay at MAISON50, we may not be able to amend your booking.
If you have booked online or by telephone and provided an email address you should notify us immediately if that email address changes. We can only discuss your bookings (including any changes) with you; we cannot discuss the booking with another member of your party unless you give express consent for us to do so.
3. Payment Terms and Cancellation Policy
We periodically review and amend the prices we charge for your use of the property. We will confirm the cost of your booking at the time you make your booking and in your confirmation.
For all bookings, full payment is required. All bookings made via our website are taken via a secure gateway. All bookings must be paid for in £GBP which include any relevant taxes which may change from time to time.
Your booking is a contract for the provision of accommodation in a specific room on a specific date or dates and this means that you do not have a statutory right to change your mind and cancel the contract other than in accordance with our cancellation policy. All confirmed bookings are non refundable.
4. Changing a Booking
If you want to change any detail of your confirmed booking you must let us know by contacting us by emailing us at [email protected] as soon as possible. Whilst we will do our best to accommodate you, we cannot guarantee that we will be able to meet any request for changes.
If we do change your booking, you will be charged an administration fee of £10 to cover the costs we incur in making the change to your booking in addition to any loss of income deemed to be as a direct result of the requested change.
Whilst we do not expect that we will have to make changes to your booking, we reserve the right to change or cancel your booking if it is necessary to perform or complete essential remedial or refurbishment works of the property or for other reasons unforeseen at the time you made your booking with us which are beyond our reasonable control. Where such an event occurs, we will do our best to offer you a suitable alternative booking. If we are not able to offer you a suitable alternative, or if you do not accept the alternative we offer, the booking will be deemed cancelled and we will refund you the total amount you have paid us for the booking.
5. Cancellation by Us
We reserve the right, in our sole discretion, to refuse any booking and to cancel any bookings already made if the building is unavailable for any reason whatsoever. If such an event occurs, you will entitled to a full refund of all monies paid to us by you. You agree that this will be your sole remedy and that we will not be responsible for any other losses you may incur arising from our cancellation of your booking.
We reserve the right to terminate our contract with you immediately and remove you and your party from MAISON50 if, in our sole discretion, we determine that you or any person in your party acts in an unreasonable, anti-social, distasteful, dangerous, threatening, reckless, offensive, derogatory, prejudicial, aggressive or violent manner or is likely to or has caused any damage or nuisance to any property or third parties on or nearby to MAISON50, or acting illegally in any way. You agree that where such an event occurs that neither you nor any member of your party will be entitled to a refund of any monies paid to us and or any other form of compensation.
We reserve the right to cancel our contract with you and ask you to leave our property immediately (without any refund or compensation being payable) to you if we consider that you or your party have committed a material breach of these Terms and Conditions.
6. Insurance
It is a condition of your booking that you obtain appropriate insurance for you and all members of your party. This should ideally cover illness, cancellation, damage or loss to property and injuries during your stay.
7. Occupancy period
You and your party shall only occupy MAISON50 as holiday accommodation and you agree that MAISON50 shall not be occupied by you or a member of your party as a sole or main place of residence. You also agree that neither you nor your party shall occupy MAISON50 for 28 days or more in any calendar year. We reserve the right to evict any persons who have occupied MAISON50 for longer than 28 days in any calendar year, or who are using MAISON50 as their main or sole residence. In accordance with our Privacy Policy which can be found on our website, an up to date register will be kept of names of all occupiers of MAISON50, their main or sole residence if that information has been provided, their date of arrival and departure from MAISON50.
8. Liability
Nothing in these Terms and Conditions is intended to limit our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation or any other liability that cannot be excluded by law.
Subject to the above paragraph, if we are held liable to you for any loss or damage arising in connection with this these Terms and Conditions and/or MAISON50, our aggregate liability to you (whether arising from negligence, breach of contract or otherwise) shall be limited to the amount of monies that has been paid by you to us.
We are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it is an obvious consequence of our breach of these Terms and Conditions or if it was contemplated by you and us at the time we entered into this contract.
Save for where your loss has been directly caused by our recklessness, negligence or breach of these Terms and Conditions, we do not accept any liability to you for any loss, theft or damage to you or your party’s property (including, without limitation, your vehicles, contents and accessories).
We are not liable for any business losses. If you use MAISON50 for any commercial or business purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
ALL OF YOUR BELONGINGS AND YOUR PARTY’S BELONGINGS ARE LEFT ENTIRELY AT YOUR OWN RISK.
YOU SHALL, AND SHALL PROCURE THAT YOUR PARTY SHALL, TAKE GOOD CARE OF AND DO NOT CAUSE ANY LOSS OR DAMAGE TO BE DONE TO THE PROPERTY, OR TO ANY FITTINGS, EQUIPMENT OR OTHER PROPERTY (INCLUDING THIRD PARTY PROPERTY) CONNECTED TO THE PROPERTY AND YOU SHALL MAKE GOOD AND PAY IN FULL FOR ANY SUCH LOSS OR DAMAGE CAUSED TO THE PROPERTY OR ANY PROPERTY CONNECTED TO THE PROPERTY WHICH IS CAUSED BY YOUR NEGLIGENCE OR RECKLESSNESS.
9. Force Majeure
We will not be responsible for any failure to perform our obligations under these Terms and Conditions that is caused by an event outside our control.
An event outside our control means any act or event that is beyond our reasonable control, including without limitation severe weather event, drought, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, strikes or industrial action by third parties, terrorist attack or threat of terrorist attack, war or threat of war, civil commotion, riot, invasion, or failure of public or private telecommunications networks.
10. Data Protection
We care about your privacy and will only process your personal data in accordance with data protection law. All the information taken at the time of your booking is used in accordance with our Privacy Policy. You acknowledge receipt of our Privacy Policy which can be found on our website.
11. MAISON50 RULES
You shall, and shall procure that your party shall comply with the MAISON50 Policy at all times which can be found here, and /or on our website and/or in our property. You and your party shall comply with all health and safety laws including, without limitation, our health and safety policies as notified to you (and as updated from time to time).
Check in and Check Out Times
Guests departing MAISON50 must please do so by 10.30hrs on the day of their departure. Guests entering MAISON50 may do so after 16.00hrs on the day of their arrival.
Pets
Guests are welcome to bring up to two well-behaved dogs free of charge. You and your party agree not to leave dogs unattended in the property at any time, not allowed dogs onto the beds, not to allow your dogs to disturb other guests and to leave the property clean on departure.
No Smoking / Smoke Alarms
Smoking is not permitted anywhere at any time in the MAISON50 building, balcony or courtyard. You and your party agree not to smoke anywhere in the MAISON50 property or courtyard and to observe the fire safety and security directions at the property. Smoke alarms are fitted throughout the property.
No Candles Or Naked Flames
You and your party agree not to light any candles or naked flames in the MAISON50 building, the balcony or the courtyard
Security
You and your party agree not to divulge the key codes to the property to any person not in your party or make copies of room keys, leave the key in the room key safe on departure and scramble the code box, not to leave doors open when the rooms are unoccupied, to keep the front door of the building closed when the MAISON50 ground floor commercial area / retail is closed, and not to allow third parties not part of your own party into the MAISON50 rooms.
Conduct of Guests
Whoever is the lead contact person making the booking with MAISON50 is responsible for the orderly conduct of all guests while staying in MAISON50. Please ensure all guests have regard to any regulations imposed by any competent authority and that nothing will be done which will constitute a breach of the law.
There are private areas at MAISON50 which are out of bounds to guests clearly marked private
Glassware And China And Cutlery And Fixtures
Please do not take any glassware, china, cutlery or fixtures away from MAISON50 or leave behind anything when you leave. If you have a breakage or a pet has an accident, please let us know and we will be happy to help clear the glass or china or pet’s accident away. If anything is broken it can cause a hazard to animals and to humans.
Health And Safety / Fire Safety
All measures have been taken so far as is reasonably practicable to ensure MAISON50 and property is safe for you to use and enjoy during your stay. Please make sure, however, that you take a little time to make yourself aware of the features of the building where relevant, to identify any hazards which you may encounter so that you can take any necessary precautions and enjoy your stay fully. You and your party agree to keep all relevant fire doors closed, not to smoke and not light any candles or naked flames at any time.
Uneven Surfaces / Steps/ Stairs
There are paved areas with concrete flagstones, external steps and internal stairs with door mats at the property. Please take extra care around these areas. When the weather is bad, paving slabs in the courtyard may become slippery. If you see anything that looks hazardous, please tell MAISON50 by email at [email protected]. Please warn your children of the dangers and ensure they are supervised at all times. Please do not leave any items on the stairs or landings as these constitute trip and fire hazards.
Lighting at MAISON50
Stairs lighting is sensor operated for safety, reduction of environmental impact compliance with building regulations, reduction light pollution. Courtyard lighting is operated by an external switch. Safety lighting is installed in the stairwell.
BBQs
Open fires or BBQ’s are not permitted at MAISON50 under any circumstances. Free standing or gas BBQs are not permitted.
Fire Emergency Information
Please refer to the fire emergency information located in the rooms at MAISON50 on the rooms’ doors and in the information folders. You can raise the alarm if you discover a fire. Make a note of where the assembly point is. Please read the evacuation notice. Fire extinguishers are provided by the front door. Please make sure you are familiar with their use, prior to attempting to put out a fire. If fire breaks out, follow the MAISON50 instructions. Keep your children safe by making them aware of the danger of emergency services rushing to the scene.
Children
Children must be supervised at MAISON50 at all times.
The parents or guardians are responsible for the safety of children in their care at all times whilst at MAISON50. Please remember you are responsible for your children at MAISON50.
Bikes, Scooters And Skateboards
Bikes, scooters and skateboards are not allowed to be ridden in the MAISON50 courtyard, for the safety and consideration of others.
Extended Stays
Extensions can be arranged, subject to availability and possible relocation, although there is no guarantee that stays can be extended beyond the date booked. If you wish to extend your stay please check with MAISON50 as soon as possible by email [email protected]..
Noise
Please consider other MAISON50 guests and neighbours and keep noise to a minimum after 10pm and first thing in the morning. We will not tolerate unacceptable levels of noise that disturbs others. In the event of any unacceptable behaviour we reserve the right to ask you to leave MAISON50. No loud music is to be played at any time.
Rubbish And Recycling
Please leave all rubbish in the bins in the rooms, or take it away with you for recycling. If you have waste such as broken glass please dispose of this carefully by wrapping in newspaper before placing in the bin, or take it with you. Hazardous waste must NOT be discarded at MAISON50.
Do’s and Don’ts For The Waste And Disposal Of Products And Liquids
The following must NEVER be discharged into the WC’s, Sinks Or Drains – WIPES of any sort, NAPPIES, SANITARY TOWELS, COTTON BUDS, rags, cooking oil or fat, medicines, any hazardous item or liquid.
Fireworks And Other Airborne Items
No fireworks to be set off on any part of MAISON50. No Chinese candle parachutes or similar devices are allowed.
Complaints
If you are dissatisfied with any aspect of your stay at MAISON50 you should bring the problem or issue to the attention of the owner of MAISON50 as soon as possible so that all reasonable efforts can be made to rectify the situation. If for any reason the issue cannot be resolved to your satisfaction you should put it in writing and email it to the owner on [email protected]. Any complaints arising out of your stay at MAISON50 that are not brought to our attention during your stay are less likely to receive the same level of attention if made retrospectively.
12. General
A person who is not a party to these Terms and Conditions shall not have any rights under or in connection with it under the Contracts (Rights of Third Parties) Act 1999 or otherwise.
These Terms and Conditions, the MAISON50 Policy and our Privacy Policy constitute the entire agreement between you and us and supersede and extinguish all previous promises, representations and undertakings.
If any provision or part-provision of these Terms and Conditions is or becomes invalid, illegal or unenforceable, it shall be deemed deleted, but that shall not affect the validity and enforceability of the rest of these Terms and Conditions.
These terms and conditions are governed by English and/or Welsh law. You and we both agree to submit to the exclusive jurisdiction of the English and/or Welsh courts.
If you are booking through our website you are agreeing to the terms and conditions and the associated policies by ticking the box on booking.
If you are booking through our website, by email or over the phone you are agreeing to the terms and conditions and the associated policies of MAISON50.
